Terms of service.
The agreement between your club and us. We have kept it as short and plain as we can; where something matters, it is said directly.
1. Who these terms are between
These terms are between Trailhead Holdings Ltd (company number 16910286, registered office 12 Lindsey Close, Brentwood, Essex, CM14 4PN, United Kingdom), “we”, and the cricket club that creates an MVP Cricket account, “the club”. The person who creates the account confirms they are authorised to accept these terms for the club.
Members a club invites (players, captains, parents, officers) use MVP Cricket through their club. Sections 3, 7 and 8 apply to them too; the rest is between the club and us.
2. The service
MVP Cricket is web software for running a cricket club: a public MVP leaderboard and player statistics, Play-Cricket sync, availability, selection, team sheets, match-day tools, match fees and subs, club communications and, on Premier, club accounting. What each plan includes is set out on the pricing page.
We improve the service continuously. We will not remove a core feature from a paid plan during a period you have paid for without telling you first and, if it materially reduces what you paid for, offering a pro-rata refund.
3. Accounts and acceptable use
- Sign-in is by email and a one-time code. Keep access to your email account secure; anyone who can read it can sign in as you.
- Club administrators control who is invited and what roles they hold, and are responsible for removing people who leave.
- Do not use MVP Cricket to break the law, harass anyone, upload content you have no right to, interfere with the service or try to reach another club’s data.
- We can suspend access that breaks these rules, telling the club why unless the law or safety stops us.
4. Plans, billing and cancelling
- Free costs nothing and does not expire. No card is needed.
- Club and Premier are billed monthly or annually in advance, in pounds sterling, through Stripe, and renew automatically until cancelled.
- You can upgrade, downgrade or cancel at any time from the club’s billing page. Upgrades take effect straight away. Cancellations and downgrades take effect at the end of the period already paid for; we do not refund part-used periods, except where the law requires or section 2 applies.
- If a payment fails and is not put right, the club drops back to read-only. The club keeps all of its data and can still collect money it is already owed. Nothing is deleted because a club stopped paying.
- We publish our prices and they are the same for every club. If we change them, we will give at least 30 days’ notice before the change applies to your next renewal.
5. Payments to your club
Match fees, subs and other club charges are paid into the club’s own Stripe account, which the club connects and owns. For those payments:
- The club is the seller and the recipient of the money. We take no percentage of it.
- Stripe charges its standard processing fees to the club’s Stripe account, and the club’s use of Stripe is also governed by Stripe’s own terms.
- Refunds, disputes and chargebacks on those payments are between the club, its member and Stripe; we provide the records to help.
- Cash and other payments marked in the app are records kept by the club. We do not hold or move club money.
6. Your club’s data
The club owns its data: its members, results, statistics, payments records and accounts. For members’ personal data the club is the controller and we are its processor. As processor we will:
- process it only to provide MVP Cricket and on the club’s documented instructions (which these terms and the club’s use of the app are);
- make sure our staff and contractors who can access it are bound by confidentiality;
- protect it with appropriate technical and organisational security;
- use only the sub-processors listed in our privacy policy, under written contracts, and tell the club about any change, giving it the chance to object;
- help the club respond to requests from members exercising their rights, and with security and data protection obligations;
- tell the club without undue delay if we become aware of a personal data breach affecting its data;
- delete or return its data when the club leaves (section 9), unless the law requires us to keep it; and
- make available the information needed to show we meet these obligations.
The club is responsible for having a lawful basis for the data it puts into MVP Cricket, including parental consent for juniors where that is required, and for deciding whether its leaderboard is public.
7. Play-Cricket
Play-Cricket is operated by the England and Wales Cricket Board, not by us. When a club connects it, the club confirms it is entitled to use its Play-Cricket data. We mirror what Play-Cricket publishes; if a scorecard is wrong there, it will be wrong here until it is corrected there. Play-Cricket’s availability is outside our control.
8. Our content and yours
We own MVP Cricket, its software and design. The club and its members own what they put in it, and give us the permission we need to host and display it to provide the service, including showing the club’s public leaderboard. With the club’s agreement we may describe it as a customer; we will never publish its members’ personal data in our marketing.
9. Leaving
A club can close its account at any time by emailing hello@mvpcricket.app. Before it does, it can export its season data from the app on Club and Premier, or ask us for a copy on any plan. After closure we delete the club’s data within 90 days, except records we must keep by law (such as our own billing records).
10. Availability and liability
- We work hard to keep MVP Cricket available and correct, but we provide it without a guaranteed uptime, and clubs should keep their own records of anything critical.
- Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or anything else the law does not allow us to limit.
- Otherwise, we are not liable for indirect or consequential loss, and our total liability to a club in any 12 months is limited to the fees the club paid us in those 12 months (or £100 for a club on Free).
11. Changes and the law
If we change these terms we will update the date at the top and, for changes that matter, tell club administrators at least 30 days in advance. These terms are governed by the law of England and Wales, and its courts have jurisdiction.
